Not content with killing and maiming its own workers, now it's going after passengers !

SMRT has settled a lawsuit brought by a woman who was paralysed from the waist down after falling into an MRT escalator gap more than three years ago.

Ms Azlin Amran, 31, sued SMRT Trains for negligence, and sought about $3 million in damages following the mishap at Tanah Merah MRT Station on Jan 28, 2013.

Neither party disclosed the final payout, if any.



"I miss being spontaneous," said the once-sporty business studies degree holder last night.

She was making her way out of the station that day, when she fell into the escalator shaft on the third step of a descending escalator undergoing maintenance.

Ms Azlin remained trapped in the escalator mechanism for more than 30 minutes until Civil Defence officers rescued her and took her to Changi General Hospital.

She suffered spinal cord damage among other injuries, which has left her a paraplegic and needing to use a wheelchair to get around.

Medical reports from various specialists were tendered to support her claims and attest to her serious condition.

Then an administrative cum operations executive, she is now severely handicapped in the labour market, according to the suit.

Through lawyer Nadia Moynihan, she alleged SMRT had failed in its duty of care, and sought special and general damages to pay for medical treatment, caregivers and loss of earnings, according to court papers filed in September last year.

SMRT left a gaping hole in the escalator stairs and yet had the audacity to bite back alleging that the victim "causes" injuries to herself by failing to keep a proper lookout ? I can understand if SMRT had just mentioned "contributed" because that would amount to admitting liability for negligence, but not the full amount of the damage sought. By saying that she had "caused" the accident, SMRT was in fact denying liability for negligence in totality. Why would anyone want to cause injuries to herself by riding on an escalator ? Even if she had been staring at her mobile phone at the time of the accident (which she never did), still there was no reason for setting up a "trap hole" in the stairs.

If it was undergoing maintenance as stated, a barrier would have been in place and one has to physically move it or bash thru it. Can't grasp why the comment on proper lookout.

The other concern I have is that no one seemed to have advised her to get a lawyer who specialise in medical cases. This lawyer is relatively junior, claims to be criminal lawyer, not even a partner to handle a claim for $3m. The Law Society and the AG should pull together some rules so that clients who are not well informed are given the right level of legal expertise. I know that lawyers cost money but in this case the probability of success is high and more case of determining the extent of liability.

I happen to agree with SMRT. The human race seems to have reached a point on the evolutionary scale where anything bad that happens is someone else's fault.

As a species, we're given 5 senses, smell, touch, sight, hearing and taste. The senses are in good working order for the majority of the population and they are supposed to be used to keep us safe from harm.

A gaping hole in an escalator does not require perfect eyesight in order to be visible. If you see a big hole in the ground, my suggestion is to avoid it or face the prospect of serious injury.

Those who walk around with the eyes closed or glued to some electronic device instead of watching where they're going deserve whatever mishap befalls them.

A Sydney-based teaching student from Singapore died on Wednesday (11 May) after she slipped and fell off a cliff a day earlier while hiking in the Blue Mountains in Australia.

According to Australian media reports, Cheng Shi Min had lost her footing while she was peering over the top of a waterfall.

Her boyfriend, Henry Yendle, told the Australian media that he and Cheng’s father rushed down as quickly as they could and found her lying face-down in the water.

“First I sort of just heard a scream and then a loud bang,” Yendle told the Sydney Morning Herald. He also said they tried for 20 minutes to pull her out of the freezing water.

Cheng, Yendle and Cheng’s father had been hiking the trail in the Blue Mountains National Park when the accident happened around 1.30pm, Sydney local time.

Surely a body falling from height would produce a loud THUD upon hitting a solid object or a loud SPLASH if it water.
