SINGAPORE: In response to a Facebook post by blogger Roy Ngerng alleging that YouTuber Amos Yee is in remand due to a breach of bail conditions, the Attorney General's Chambers (AGC) has clarified that Yee is remanded "because there is no bailor".

In his Facebook post, Ngerng said: "The bail terms are ridiculous. Amos was not allowed to post anything at all. When asked how his latest posts meant he violated the bail terms, I understood it was said that the content was 'irrelevant' and he has violated the bail terms anyway, and so had to be remanded."

The AGC said Yee "is remanded not because of breach of bail conditions", but because no one posted bail.

The AGC added that Yee's bail is in "non-cash terms". "In other words, the bailors need not deposit the cash value with the Court."

"Instead, they have to pledge that they are good for the money and demonstrate that they are able to effectively ensure attendance of the accused and also ensure his compliance with bail conditions," a spokesperson for AGC said.

The spokesperson added that the earlier requirement that only Yee's parents can furnish bail has been lifted by the court, at the suggestion of the Public Prosecutor.

It is not understood exactly why Yee's bail was swapped from a police bail to a court bail as the prosecutor had told reporters on Friday that they did not request for Yee's original bail to be revoked.

AGC explained that the court bail offered is $20,000 but it does not have to be in cash-terms meaning that the amount does not need to be paid upfront.

Earlier, the court had also required that Yee's bailors had to be his parents due to his age but this conditon has been lifted. Instead, the bailor just needs to be able to demonstrate that they have the means to pay $20,000 and that they can effectively control Yee to make sure he appears in court on the set dates.

On the issue of the law, here it is. Amos Yee's alleged offences are bailable.
He is not a flight risk or a risk to society, as he is not a murderer or a gun-toting robber.

The judge most likely may have erred on his readings of the law to set conditions for allowing the bail, in my opinion.
The bail is set in accordance to whether it is allowed for the offences to be heard.

For example, someone who is charged for molest is allowed bail. Capital offences which involve the death penalty, such as murder, are non-bailable. Some offences which are more serious in nature are also non-bailable. These include rape, kidnapping or voluntarily causing grievous hurt using dangerous weapons. However, the court has the discretion whether to award or deny bail on a case-by-case basis.

For bail amounts of $15,000 and below, personal property such as jewellery and moveable household items may be used as collateral for bail. There is no need for the surety to show proof of ownership of such property when proceeding with bail. For bail amounts more than $15,000 however, only monetary collateral in the form of physical cash, savings account funds or fixed/time deposit funds will be accepted.

So, to set the bail at $20,000, the money collateral is real, hard, cold cash that can be used as collateral and not just simply signing of a security or bond, without the need for proof of actual collateral used for the bail.

On another front, in the case of bailable offences, which Amos Yee's 3 charges fall under, the grant of bail is a matter of right. While conditions and terms can be set by the judge, it must be specific to the charges, like to prevent tampering of evidence, leaving the country of jurisdiction and reporting to the IO daily but conditions and terms should not remove or curtail any individual rights of the alleged offender that prevent him from managing his personal, financial and social affairs, in my opinion.

I think that it is usual to have the police bail converted to a court bail once you attend court for the charges to be read to you. In fact, it should have been done on day one and not until the pre-trial conference. Police bail and court bail not much difference. It is the amount of bail that is important. To set it to $20k is tougher for the bailor as he or she has to show proof of the collateral.

So when is his next hearing? If it is 2 weeks later, then he will remain in the Cantonment lockup till then.

On the issue of those conditions, it is like admitting guilt before he can put up his defense. The judge is funny man. Such conditions are on the assumption that he will plead guilty, but he did not, as he wants to engage a lawyer, so this means he will fight the charges.
To disallow him to have the means of funding his defense is the same as sentencing him, since as a 16 year old, he has no money to engage his defense and he is tried in a court as an adult, so the court cannot expect his parents to fund him, since he is already considered an adult by the court.

In any case, Amos Yee could have a big bump while in remand and went into amnesia and due to the trauma, he could easily forget his passwords and his own name. On the flip-side, if he should attempt suicide while in remand, then this matter will escalate to a bigger audience and he would spend his time at the hospital, most likely Changi General Hospital, since he is remanded at Bedok Central, but I think he will could be transferred to Cantonment and remanded there, not sure, depending on where the IO is stationed. Anyone can shed more light on this?

Yes, it's a laughing stock of the whole civilized world. But I just realized that Singapore ISN'T part of the civilized world. Many of us are still basically at the barbarian stage. If you think Amos deserved to be sent to jail because of some archaic and nonsensical sedition and harassment laws made up by PAP, then you also deserve whatever shit PAP dishes out to you. Amos is now remanded in Changi Prison. And if he is not bailed out, he will remain in remand. Anything can happen to this youngster every day he is in prison.

The AG is wrong ...because the judge changed the bail terms ...not allowing anyone to bail him except for the parents. The prosecutors then had to asked the judge to revert back to the previous term.

So, Amos was remanded because the judge, plausibly acting on direction from someone, changed the bail term, possibly knowing that the parents will let Amos rot in jail.
