Roy Ngerng found guilty of defamation

SINGAPORE: Blogger Roy Ngerng has been found guilty of defamation, with damages to be assessed.

Justice Lee Seiu Kin on Friday (Nov 7) has also ordered Ngerng to be restrained from publishing or disseminating the allegation that the plantiff, Prime Minster Lee Hsien Loong, is guilty of criminal misappropriation of the monies paid by Singaporeans to the Central Provident Fund, or any words and/or images to the same effect.

"I therefore find that the Disputed Words and Images convey the natural and ordinary meaning that the plaintiff, the Prime Minister of Singapore and the Chairman of GIC, is guilty of criminal misappropriation of the monies paid by Singaporeans to the CPF," said Justice Lee in his judgement. "There is no doubt that it is defamatory to suggest that the plaintiff is guilty of criminal misappropriation of the CPF monies."

The Prime Minister filed the defamation suit against Ngerng on May 29, and on July 10 applied for a summary judgment, where the plaintiff asks the court to rule without trial, on grounds that the defendant has no real defence to contest his claim.

The suit against Ngerng arose from a blog post in May entitled Where Your CPF Money Is Going: Learning From The City Harvest Trial, which alleged that CPF monies had been misappropriated.

Ngerng had been sent a letter from Mr Lee’s lawyers, demanding that he apologise, remove the post and offer damages. Though he complied with several of the demands, his offer of S$5,000 in damages was rejected as “derisory” by Mr Lee. Mr Ngerng had also emailed some local and international media on how to access other posts, which Mr Lee’s lawyers said was “further aggravation”.

In a blogpost on Friday, Ngerng wrote that he was “disappointed as I have never intended to defame the Prime Minister”. He added he would continue to “speak up on the CPF and other issues that concern Singaporeans".

President Joko “Jokowi” Widodo has forgiven Muhammad Arsyad, a satay vendor who was detained by the police for allegedly defaming him online.

Jokowi said he forgave Arsyad during a meeting with the satay vendor’s parents, Mursidah and Syafrudin, at the State Palace on Saturday.

“I forgive him 100 percent. I forgave him through his parents,” Jokowi told reporters. First Lady Iriana was also present during the 30-minute meeting.

Jokowi added he had asked the police to release Arsyad from detention. “Regarding the legal process, I will check on it again later. But most importantly, I already asked [for the detention to be postponed],” he said.

Jokowi also called on the public to learn from Arsyad’s case and promote decency and respect for others online.

“I ask Arsyad to be careful in his actions,” Jokowi said.

Speaking after the meeting, Mursidah said that Jokowi was not offended by what his son had done. “I was only told to take care of my son,” she said.

In the presence of members of the media, Syafruddin kissed Jokowi’s right hand, a sign of deference in the local culture.

Mursidah also said after the meeting that the First Lady had given her cash in a sealed envelope.




Arsyad was arrested at his parents’ home in Kramat Jati, in East Jakarta, on Oct. 24, based on a report filed in July by Henry Yosodiningrat, an Indonesian Democratic Party of Struggle (PDI-P) lawmaker and a member of the party’s legal team, when Jokowi, then the governor of Jakarta, was engaged in a campaign battle with Gerindra Party chairman Prabowo Subianto.

Arsyad was charged with defamation and spreading pornographic material, a violation of the 2008 Pornography Law, and could face 12 years in prison.

The team reported a Facebook account registered under the name of Arsyad Assegaf that had posted a series of doctored pornographic images with the faces of Jokowi and Indonesian Democratic Party of Struggle (PDI-P) chairwoman Megawati Soekarnoputri.

Not only that, Sinkieland claims to be a first-world nation, an advanced economy, in the league of the US, Canada, Western Europe, Australia and NZ. Tell me: which President or Prime Minister of the above countries sued their citizens for defamation? Sinkieland is a first world country with THIRD class Prime Ministar and Prime Miniature.

The justice process in this country is a joke!!!!whoever heard of summary trial?even the guiltiest murderer in USA gets a full trial.
