SINGAPORE - Blogger Roy Ngerng, co-leader of a Sept 27 Hong Lim Park protest march that disrupted a YMCA charity carnival, confirmed in a Facebook post on Thursday night that he will be charged in court on Monday.

The Straits Times understands that protest organiser Han Hui Hui, 22, is also being charged along with several others.

They have been asked by the Police to turn up in the State Court in Havelock Square on Monday to answer to public nuisance charges.

Earlier on Thursday, two other people who took part in the protest march were given a conditional warning. A police spokesman said the warnings were served to "two individuals who had participated actively at the event".

"These actions are taken after careful consideration of the facts and circumstances of the case, and in consultation with the Attorney General's Chambers. The investigation outcome for the remaining individuals will be made known to them in due course," said the spokesman, when responding to queries from The Straits Times about the warnings.

It is understood that the conditional warning given to the two individuals was for an offence of public nuisance under the Penal Code.

Such a warning - given in lieu of prosecution - requires that the offender maintain a clean record for a specified period, usually 12 or 24 months. If he commits a new offence, he can be charged with the new offence as well as the previous one.

The two individuals, along with those who will be charged on Monday, in question were among several who were investigated over the Sept 27 protest.

Ms Han and Mr Ngerng led several hundred people in a march around the park, encroaching on the lawn where the charity carnival was held and frightening some children with special needs who were performing on stage. The demonstrators waved Singapore flags and also shouted chants, including "Return Our CPF" and "Vote Them Out, PAP".

On Thursday, lawyer M. Ravi, representing Ms Han, wrote to the National Parks Board (NParks) asking that the government agency approve an application to hold protest rally on Saturday at Hong Lim Park.

Ms Han originally received approval to speak and to stage a demonstration on Saturday, but was informed on Tuesday by the NParks that the approval had been cancelled.

NParks said on Thursday night, in response to The Straits Times, that it would stick to its decision despite the letter from Ms Han's lawyer.

NParks cancelled the approval on the advice of the police as Ms Han was being investigated over a the Sept 27 protest.

But Mr Ravi said in his letter on Thursday that NParks' action amounted to "a breach of (Ms Han's) rights of freedom of speech and assembly".

NParks said it did not agree with Mr Ravi, and would not change its mind about the cancellation of the approval.

SINGAPORE - Six people, including activist Han Hui Hui and blogger Roy Ngerng Yi Ling, who took part in a Hong Lim Park protest last month which disrupted a charity carnival held in an adjacent lawn, were charged on Monday for public nuisance.

Han, 23, and Ngerng, 33, were additionally charged with allegedly organising a demonstration without approval.

The duo appeared in court dressed in all-white: Ngerng in a white long-sleeved shirt and pants, and Han in an all-white outfit paired with white spectacles and a white hairband.

The four other accused - who each face a charge of public nuisance - are Low Wai Choo, 54; Chua Siew Leng, 42; Goh Aik Huat, 41; and Koh Yew Beng, 59. There was no immediate information available about their occupations.

The six are accused of allegedly disrupting a YMCA charity carnival on Sept 27, held at the same time as their Return Our CPF protest rally, by marching around the general vicinity of the carnival, shouting loudly, chanting slogans, waving flags, holding placards, blowing whistles loudly and beating drums "in furtherance of the common intention ... to disrupt the YMCA event".

The six are represented by lawyer M Ravi, who requested for more information to be shared by the prosecution via a pre-trial Criminal Case Management System. This is where the defence and prosecution meet without a judge present, to discuss their cases frankly and in private.

Public Prosecutor John Lu had no objection to Mr Ravi's request and the case has been adjourned till Nov 24 for a pre-trial conference on Nov 24.

In court on Monday, the six accused appeared composed, and chatted among themselves at times.

A group of about 10 friends and supporters watched proceedings from the public gallery.

Mr Ravi told reporters afterwards that his clients were anxious initially: "But now, they have been briefed on the law, and they are much calmer."

Anyone convicted of a charge of public nuisance can be fined up to a maximum of $1,000. As for the charge of organising a demonstration without approval, the penalty is a fine of up to a maximum of $5,000.

The latter offence falls under a regulation which says that no one can carry out public speaking activities, organise or participate in a performance or exhibition, or organise any demonstration without the Commissioner of Parks and Recreation's approval.

Mr Ravi also said on Monday that he will put up an application to challenge the Parks and Trees Act. He told reporters: "Nowhere in the Act does it give the Minister power to regulate free speech and assembly. Parliament has not conferred that authority on the Minister under the Act."

The police said last Friday that their investigations into the "Return Our CPF" protest at Hong Lim Park on Sept 27 covered a total of 14 people.

A group of five who "participated actively at the event" were given conditional warnings, the police said, adding that the case against them has concluded.

A conditional warning means they must not commit any offence for a specified period, usually for 12 or 24 months. Should they do so, they will be charged with new as well as the existing offences.

Meanwhile, the outcome of investigations for the remaining three individuals "will be made known to them in due course", the police added.

Hong Lim Park protest court case: Next pre-trial conference to be held on Dec 15

SINGAPORE - A pre-trial conference at the State Courts on Monday for the case involving six people charged with committing a public nuisance act at Hong Lim Park on Sept 27 has been adjourned to Dec 15.

The six were charged last month . Two among them, activist Han Hui Hui and blogger Roy Ngerng Yi Ling, were also charged with organising a demonstration without approval.

Asked after Monday's closed-door hearing whether the six will enter a plea - having not done so when they were first charged - lawyer M Ravi told reporters that there has been no indication yet from his clients.

He also declined to comment further when asked for further updates about the case, and an appeal which Han sent to National Development Minister Khaw Boon Wan against a National Parks Board decision not to allow her to hold events at Hong Lim Park while her case is ongoing.

Don't enter plea.........better still jail, then one or two of them become martyrs and die in prison due to ill-treatment.
The worst scenario is kanna fined, then cannot pay, become bankrupt.....then all effort wasted.....but such charges cannot
become bankrupt, because it is not defamation, but criminal charges like public nuisance, so if don't pay fine, will get thrown
in jail............hence, don't enter plea better lah......make the case a fireworks display.

Activist and blogger Han Hui Hui was on Monday (June 27) fined $3,100 for co-organising a protest rally at Hong Lim Park without approval on Sept 27, 2014, and disrupting a charity carnival being held at the park then.

She and five others, including blogger Roy Ngerng Yi Ling, were accused of disrupting the YMCA Proms @ The Park charity event for children with special needs, which was held at Hong Lim Park at the same time as the Return Our CPF protest rally.

Han, 24, was fined $600 for being a public nuisance and $2,500 for organising a demonstration without approval.

Han told the court that she has prepared a notice of appeal.

Two others, Koh Yew Beng, 61, and Low Wai Choo, 56, were each fined $450 after they were found guilty with Han.

Ngerng was fined a total of $1,900 - $400 for being a public nuisance, and $1,500 for organising a demonstration without approval - in October 2015.

Chua Siew Leng, 43, who does not hold a regular job, pleaded guilty in March 2015. She was fined $300.

Goh Aik Huat, 42, had been given a conditional warning.

During the rally, the six grew "more emotive" when Minister of State Teo Ser Luck, the YMCA event's main guest, arrived at the park.

They marched four times around the general vicinity of the YMCA event, shouting loudly, chanting slogans, waving flags, holding placards, blowing whistles loudly and beating drums.
