While looking up unrelated things on the internet, I was quite surprised to find the following which involved Calvin Cheng very intimately. Basically, Calvin Cheng "played a central role" in price-fixing as president of the Association of Modelling Industry Professionals (AMIP). On 23 November 2011, the Competition Commission of Singapore (CCS) found 11 modelling agencies guilty of price-fixing, using the AMIP as a "front" for collusion.

Why is this important? Calvin Cheng was a Nominated Member of Parliament from July 2009 till May 2011 (when Parliament was dissolved for the General Election), and he had the privilege of influencing and deciding upon (to whatever extent) policy. Even today, he wears that badge proudly and claims to speak from a moral high ground. It is very clear from the documentary evidence that Calvin Cheng knew about the existence of the Competition Act, and he was keen to avoid the appearance of price fixing. In other words, he knew he was doing wrong, and he did it all the same.

"CCS notes that the evidence shows that Calvin Cheng, as then president of the AMIP, played a central role in coordinating the actions of AMIP members." (point 213h, page 85 of Infringement Decision, Case number CCS 500/002/09 dated 23 November 2011)

"Calvin Cheng had given instructions to the Parties on how to mask the fact that this was a collective action on the part of the Parties raise rates so as to avoid attracting attention and complaints." (point 371, page 129 of Infringement Decision, Case number CCS 500/002/09 dated 23 November 2011)

Calvin Cheng filed an appeal, which was disallowed, and in the appeal decision, it writes:

"Mr Cheng complains that those parts of the Infringement Decision quoted above are highly damaging to his character." (point 20, page 8 of Appeal No 1, dated 31 May 2012)

The character of people who speak out is important. Even Calvin Cheng realised that what was said about him was damaging. You decide whether his character is suitable or not.

Below is the evidence which is freely available from the Ministry of Trade and Industry and the CCS website.

The basic sequence is that on 23 November 2011, the CSC announced that it was sanctioning 11 modelling agencies "for breaching the Competition Act" (1). The evidence and judgement were presented in the Infringement Decision (2).

Some of the modelling agencies involved, as well as Calvin Cheng personally, appealed the decision of the CCS. Calvin Cheng's personal appeal was referred to as Appeal No. 1 (3), while the appeal of the agencies were divided into 2 appeals, Appeal No. 2, and Appeal No. 3. It is important to note that the modelling agencies did not dispute the fact that they were guilty, but only the amount of fines they received. The amount of fines were reduced on appeal. As for Calvin Cheng's appeal in his personal capacity, it was disallowed on the grounds that he had no right of appeal. I'm glad many of you share the same sense of outrage that I felt when I found out about what Calvin Cheng had been sanctioned for. But there are some who don't get it. So, I would just like to add some more thoughts which I left out because I didn't want to overload the original fact presentation.

Anyway this is another update from Calvin Cheng on the incident:

He thinks that price fixing is no big deal and clearly is still clouded by greed to make more money from his modelling agency. We did stated that this news is back in 2011 and didn't say this is the latest news. Obviously, he has nothing to defend himself against so he starts making personal attacks and labels all the 2.1 million unique visitors that reads TRS every month as 'MORONS'.

The very first point that I would like to make is that I don't subscribe to any of the local newspapers, but I do read whatever free news they provide. So the reason I was so surprised when I found out about the naughty things Calvin got up to is that I obviously missed the news entirely when it first appeared. And it surprised me even more because IT IS A BIG DEAL. For those of you who think it is old news, good for you. But if it's old news to you and you still support Calvin Cheng, you need to reconsider, seriously. Why?

FAILURE OF THE PARLIAMENTARY SPECIAL SELECT COMMITTEE

The initial complaint was made to the CCS on 13 February 2009. The CCS report does not reveal when they decided to investigate further, but the "simultaneous unannounced inspections" were made on 15 July 2009. I cannot find the exact date Calvin Cheng was announced to have been nominated as NMP, but there was a controversy over Calvin Cheng being a lapsed member of Young PAP around that time. There were some articles dated to around 10 July 2009 discussing this. So, the inspections were made after Calvin Cheng had officially been announced as an NMP.

Wait, how can someone who has this hanging over him be allowed to participate in the decision making of the body in which the sovereignty of our republic is invested? Calvin Cheng, as a nominated Member, had the right to vote on all matters of parliament (except for a few categories)! The honourable thing for Calvin Cheng to have done, once he found out he was being investigated, is to resign. The necessary thing for the Parliamentary Special Select Committee is not to have nominated him in the first place, and to have suspended him whenever they found out.

As it is, Calvin Cheng served out his entire term as NMP, and only then did the final decision come out!

CALVIN'S SPECIAL PLEADING

As it turns out, Calvin Cheng was singled out for mention in the final report. His agency was fined for its part in the price fixing, and in the original finding, the fact that Calvin Cheng was the instigator warranted an additional 15% fine on his agency (note: later removed on appeal). Sure, his crime is not arson, or murder, or rape, but the law he contravened is very clearly and simply defined (just don't talk to any one at all about prices). Is it really that hard to follow?

Calvin Cheng obviously is very proud of it since he pasted it himself once people started asking him on Facebook. In it, he admits he was "technically wrong", but that his "intentions were noble". Drug traffickers also will say they do it for their mother's medical treatment or sister's education. It does not matter how good his intentions were (if they were even so), he knew the law and he chose to break it. Laws aren't guidelines for privileged people to choose to follow or not to follow at their own whim.
Calvin Cheng says on his Facebook he does not respond to The Real Singapore. Sure, he does not need to. The Competition Commission of Singapore has already said all that needs to be said. In fact, the Straits Times immediately afterwards published a response from the CCS in the forum rubbishing Calvin's special pleading [Link]

It is for those of you who are still supporting him who need to respond in your own heart.

If what he has done and his justification afterwards (he still "is standing by" his illegal activity) does not shock you, and you die die still want to support this sort of person, then I'm sorry, the decline of Singapore is squarely on your shoulders. It's not even that there are no unrespectable people at all left in the PAP (Denise Phua came out against the casino industry just recently; turn your support to her lar). I don't care what political types people support, as long as these types are sensible, and moral. Like you all like to say, must distance yourself from the crazies. Calvin Cheng isn't a crazy: he merely believes himself above the law.

To quote someone whom Calvin Cheng very buddy-buddy with, now is the McCarty-Murrow moment (whatever the hell that means): "Do you support someone who thinks himself superior to the law or not?" That is all you need to ask yourself.

PS Bonus: Next time he says Singaporeans are "shite" for not getting jobs in the face of foreign immigration, quote his interview: "Too much competition on supply side, too little competition on demand side, what happens? Prices collapse." And how does he know? He is an "economist by training".

I don't think the greatest danger to Singapore is represented by Roy Ngerng, Han Han Hui and their supporters. Their views are so extreme, their actions so absurd, that few would support them.

Moreover, the issues they represent, are bread-and-butter issues and the PAP are if nothing, good at solving these issues with their well-honed technocratic skills. They just need time.

The biggest danger I feel are an emerging group of Westernised, educated, champagne socialists and latte liberals who pontificate about social inequality, democracy and freedom in the comfort of their condos. They theorise about the rights of workers, whilst cocooned in their suits at their white collar jobs. They write poetry and make films about injustices, but the greatest injustice they think they have suffered is the censorship of their 'art'.

They fight for Western liberal democracy, and a two-party state, not because it will make the lives of Singaporeans better in tangible ways, but merely because it is a 'human right'.

These are also the people that the PAP can never hope to win over, even if the same people have pretensions of being intelligent, rational 'swing voters'. This is because if their concerns are not bread-and-butter, no matter how many new trains the Government buys, no matter how many flats they build, they will not be satisfied.

They will only be satisfied if Singapore becomes like the Western societies they worship, and we have a competitive, multi-party democracy.

That is, they will only be satisfied if the PAP LOSES. In order to make them happy, the only way is for the PAP to continue losing.






That is why I think the PAP should continue do what they do best, and solve the bread-and-butter issues for the people who have real problems with cost of living, jobs, housing etc.

The ideologues are a lost cause.

I just hope the cancer of these champagne socialists, these self-absorbed, West-worshiping faux-intelligentsia will not spread.
Otherwise Singapore is lost.

Editor's Note: In November 2011, Looque Models Singapore (of which Cheng is both a shareholder and director) was prosecuted under Singapore's Competition Act for price-fixing activities and fined S$31,241.
In its written judgment, the Competition Commission of Singapore (CCS) also stated the following:
"There is sufficient evidence that Cheng played a central role in coordinating the infringing conduct. He was an active President of the AMIP (Association of Modelling Industry Professionals), and the other Parties looked to him for advice and director. CCS will therefore retain the uplift for aggravating factors."
