Stomper Chew's relative, a cabby, was involved in a collision with this woman, who had apparently dashed across a road into the path of his taxi.

According to the Stomper, both the cabby and the woman were charged by the traffic police for reckless driving and failing to keep a lookout for traffic respectively in the wake of the incident.

Immediately after the accident occurred, both the cabby and his passenger had alighted to render assistance to the woman, who appeared to have suffered a sprained ankle and was left limping.

The Stomper wrote:

"This incident happened in January this year.

"As seen in the video, the woman jumped over the road divider before bumping onto cab.

"The woman was definitely not watching out for moving vehicles before crossing.

"The driver is currently being charged for reckless driving, while the woman is being charged for failing to look out for moving traffic.

"We've been trying to appeal with the different departments but to no avail.

"Although we feel that this is not fair, there are few options left.

"We hope that by sharing the video, drivers out there will be more alert."

Stupid bitch had a death wish. Crossing the road while looking away from the direction of incoming traffic. If the authorities are so hasty in charging the taxi driver for reckless driving, she must be a foreigner or have powerful, well-connected friends.

The driver must anticipate such stupidity, so he should be charged with reckless driving.

From the start of the video, can see that the driver is quite careful in his driving. That PRC fucktard bitch deserved to be knocked down

not that the taxi driver could've done anything to prevent the reckless twat from hitting his cab.
hence, it's recklessly reckless to charge him for reckless driving.....

What rubbish. It was so obvious from the video that the stupid pedestrian was going to cross without looking. Any sane driver would have tooted the horn and prepared to stop before showing the pedestrian the finger.

After cabby charged for reckless driving still can continue to drive?

After studying the video, I agree with TP decision to charge the cabby; although I will not comment if 'careless driving' (a lighter sentence) might be better than 'reckless driving (more serious offence): without the experience of precedent sentences.

Firstly, the Chinese girl, might be silver spooned Sinkie or foreigner. Either not sure of Singapore right/left hand drive status, thought the street was a one way street, or most likely thought it was HER GRANDFATHERS ROAD.

Secondly, the taxi to ncle SHOULD NOT have accelerated so fast on the narrows street especially before an obvious obstruction (by truck in front) AND especially because it were a housing estate: some playful child could have easily fallen off the roadcurb and taxi uncle would have killed the child since he had NO TIME TO SWERVE and less so perform emergency brake. Passenger also didn't tell driver to hurry, so why was uncle in such a rush???!!!

It almost ALWAYS takes two hands to clap; and in this case, I very much agree with TP that BOTH parties are blame worthy for their respective parts.

Pls remember, a taxi driver in Sinkaporean is NOBODY, only the following people can set, if not bend the law:
[1997]: When breaking the law for partisan gain, its always good to direct the services of the Attorney General to 'get out of jail free':...

(Pict source)

And pls do not speed in housing estate areas just to earn a few more bucks to compete with the following greedy PAP politician who spews every excuse to defend benchmarked to CEO level salaries. Vote for politicians who seek first to improve the lot of workers rather than enrich themselves...
Greed and pride always come before fall. I believe that the following politician will not last very long...
"If the annual salary of the Minister of Information, Communication and Arts is only $500,000, it may pose some problems when he discuss policies with media CEOs who earn millions of dollars because they need not listen to the minister's ideas and proposals. Hence, a reasonable payout will help to maintain a bit of dignity."

His in car video camera did him in. He did not come to a complete stop at the junction before turning left. Factually no connection to the accident but inferentially drawn in with his subsequent act of unnecessary fast acceleration to conclude that he was driving recklessly. He also did not keep a proper lookout. He had not been scanning the situation in front of him to anticipate danger and other road users.

Negligence is a legal theory that is the basis for many car accident lawsuits. If you've been in a car accident and have been sued or are suing the other party, there's a good chance you've heard the term "negligence" kicked around. But what exactly is negligence and how do you prove it? Here's a primer on using negligence as a basis for recovery in car accident cases.

What Is Negligence?

When a person is negligent, it means that he or she has behaved in a thoughtless or careless manner, which has caused harm or injury to another person. A person can be negligent by doing something that he or she should not have done (for example, running a red light or speeding), or by failing to do something that he or she should have done (for example, failing to yield, stop for a pedestrian, or turn on lights when driving at night).

Negligence is a legal theory often used in car accident cases. A driver must use care to avoid injuring other motorists, passengers, or pedestrians -- basically, anyone that he or she encounters on the road. If a driver is not reasonably careful and injures someone as a result, the driver is liable for injuring the accident victim.

Elements of a Negligence Claim

The person who brings the lawsuit (called the plaintiff) must show that the defendant (the person being sued) was negligent. (For more on how to prove your personal injury case, see Nolo's article Car Accidents: Proving Fault.) If you are the plaintiff, you must show all of the following:

The law required the defendant to be reasonably careful. In car accident cases, the law requires drivers to be careful when encountering anyone they meet on the road -- passengers, persons in other vehicles, and pedestrians -- so this one is a given. This is called the "duty of reasonable care."

The defendant was not careful. This is called "breaching" (or violating) the duty of care. In determining whether a driver was sufficiently careful, the law compares the driver's conduct with the conduct expected of a "reasonable person." The law asks: How would a reasonable, prudent person have behaved in the same or similar circumstances?

If the defendant's behavior falls short of how a reasonable person would have acted, the defendant has violated the duty of reasonable care. Examples of conduct expected of a reasonable driver include:
•stopping at a red light
•watching for crossing pedestrians, and
•following the vehicle in front at a safe distance.

Unfortunately, the lady is the type of people i have been warning driver against for many many years. They look at the wrong side of traffic when crossing or uses their handphone with an "personal protection device" or latest pseudo shield app.

Running across roads with oncoming vehicles with their "shields" covering and "protecting" their faces against all kinds of perils. So many just walk oblivious that they are not being responsible for their own safety.

Sure the driver may be wrong, MAY get fined, punished with jail or banned from driving but you will very LIKELY get maimed, no limbs, disabled or dead. What comfort is it to you and your family then? Don't argue with an oncoming car or train, just be careful and if need be get out of the way. Leave the right or wrong to later when YOU are safe.

Accidents, much like war does not determine who is right, it only determines who is left.

On a lesser financial note, accidents also determine how much NCB you have left so drivers please please drive with care (a motor car unfortunately is still a deadly weapon few recognizes) and folks on foot please remember that the next time you feel like dashing with abandon (and dash your head against someones bumper). No matter how soft the "crumple zone" is on a car, it will always be harder than your head which will likely be the only thing crumpling.

Remember why you are out there in the first place, it is to have fun/go somewhere/do something/meet someone, not to end up in injured or lying unconscious in a hospital, paralyzed lying helplessly somewhere or worse, covered in a white sheet on the morgue stainless steel frame.

It is expensive enough for funerals and hospitals as it is and worse if its hospital and then funeral, please do not burden your family because your belief in the iDevice is stronger than your sense of self preservation. Remember, there may still be leftover warranty for your iDevice but other than insurance payout, there is no replacement for you (no matter how generic you think you are.)

Please think first before you activate that shield when:

1. Running across the road like you were born free (Reality check, this being a certain country, all your CXX are belong to us)
2. Running across the road looking elsewhere
3. Running across the road with an umbrella looking elsewhere with your iDevice
4. Cycling across the road with an umbrella and construction helmet covering half the face and talking to an iDevice and almost crashing into a bus
5. Yakking on your iDevice when crossing zebra crossing such that a motorcyclist helmet collided with your head and you end up in a coma, waking up 4 days later with no clue, a bad headache and a memory loss. (happened to a friend)

Remember, accident victims may also have their internals taken out for analysis or harvested for donations with lots of highly professional medical staff asking your family members earnestly to just "quickly let him/her go" so as to maintain the quality of the organs, all the while stressing the high costs you can save. (Satire mainly, i am full of respect for medical people and am somewhat sure no medical staff ever does this)

As the quality of drivers on the roads (including public/private transport, goods and construction vehicles) these days VARIES GREATLY, please please take reasonable care of yourself and warn your loved ones.

(Apologies for the graphic and true details, i will rather scare you with the details and see you take better care of yourself than to see you splattered on/across/in the road as another statistic, remember the driver may well be at fault but it will just be you at the Hospital/Morgue/Rememberence hall)
