Alleged rape victim begs motorcyclist for help

A SWEEPER told a district court on Monday how a woman had blocked his way and hopped into the side car of his motorcycle and asked him to take her home.

The 60-year-old man said the woman appeared 'afraid' and refused his money to take a cab home on Feb 12, 2009.

He testified that the young woman had stepped out of a side road of Block 203 Toa Payoh North sometime past 6am and was waving frantically at passing vehicles. But they did not stop.

She them came up to his motorcycle with opened arms and asked him to to take her home.

As he was in a hurry to deliver goods, he offered her money to take a taxi home but instead, she hopped into the side car and he then took her home.


As soon as she arrived at the house, she got down and ran towards her mother and hugged her.

He was testifying on the first day trial of Ong Mingwee, 28, who denied raping a then 22-year-old woman at his flat in Toa Payoh North in the early hours that day.


Ong, who helps his father in a minimart, is defended by Ms Goh Siok Leng. The trial continues.

A WOMAN broke down on the witness stand on Monday while testifying at the trial of a man accused of raping her daughter.

The 51-year-old housewife was recounting the events of Feb 12, 2009, when she lost her composure. She was one of six witnesses called to the stand at the start of the trial of Ong Mingwee.

The 28-year-old accused, who helps out in his father's minimart business, claimed trial on the charge of raping the then 22-year-old woman at his Toa Payoh North flat in the early hours of that day.

On Monday, Ong was more than an hour late for his hearing.

His lawyer, Ms Goh Siok Leng, tried calling him, but to no avail.

She then spoke to Ong's father, who said he had left home.


When the court convened at around 10.15am, District Judge Hamidah Ibrahim gave the benefit of the doubt to Ong, giving him 30 minutes to appear.

He arrived at about 10.40am and counsel apologised on his behalf.

A YOUNG woman told a district court on Tuesday that a man took her friend to his place instead of taking her home after a night out at Zouk.

The 23-year-old said her friend, then 22, sounded 'a bit scared' and wanted her to come and get her, but she had no idea where she was on Feb 12, 2009.

She was testifying on Day 2 of the trial of Ong Mingwee, who is said to have raped the woman at his flat in Toa Payoh North in the early hours of that day.

The court heard that the witness texted her friend at 4.43am when she realised that her friend had not sent her any SMS informing that she had arrived home.

It was their practice to SMS each other when they got home after clubbing.


Earlier, the two women had met Ong, known to them as Ken, for the first time at the club through a mutual friend.

Ong, now 28, had danced with the alleged victim, who was 'quite high' and was not very stable by the time the club closed at about 4am.

The witness said she got Ken's mobile 'just in case' after learning that he had agreed to take the 22-year-old home.

But instead, he took her to his flat and allegedly raped her. The alleged victim subsequently went home on her own after hitching a ride from a three-wheeler, ridden by a sweeper, nearby.


The witness testified that when she called her friend, she asked her to come and get her. But neither of them knew where Ong lived. He also did not pick up the witness' calls nor returned her messages.

When the witness spoke to her friend the second time, she said she sounded 'even more scared'.

She added: 'I can't remember if she was crying. She kept asking me to come and pick her up. I told her I could not pick her up because I did not know where she was.'

The case continues.

Moral of story, if U drink, (i) don't drive, (ii) don't go home with strange men.

Better still, dun drive to drink, dun drink in the company of strange men/ less then trust worthy people.

Its perhaps best not to drink at all.

Anyhow, dis should be an interesting case as it involves a female lawyer defending her male client against the allegations of rape; judge also is female- how they discuss and decide upon culpability would be an interesting point to see.

The poor victim should take this as a stiff and permanent lesson and hopefully abstain from alcohol and its associated troubles; though this doesn't abstain Mr Ong MW from blame (he should be more punctual in court too- stupid dumb dumb!!!).

Whatever the case, I think that sweeper uncle is the ultimate hero in this case. He truly deserves special mention for going out of his way to help the poor girl whom nobody else stopped to help.

Kudos sweeper uncle, you are a hero to us all.

The 28-year-old accused, who helps out in his father’s minimart business, claimed trial on the charge of raping the then 22-year-old woman at his Toa Payoh North flat in the early hours of that day.
Yesterday, Ong was more than an hour late for his hearing.
His lawyer, Ms Goh Siok Leng, tried calling him, but to no avail. She then spoke to Ong’s father, who said he had left home.

When the court convened at around 10.15am, District Judge Hamidah Ibrahim gave the benefit of the doubt to Ong, giving him 30 minutes to appear. He arrived at about 10.40am and counsel apologised on his behalf.

The alleged victim’s mother gave evidence that she was awakened by a call from her daughter, who was crying and calling out for her.

The housewife said she could not understand what her daughter was saying – and then the line got cut.
She called her daughter back immediately, and a man answered, identified himself as Ken and said he was a friend. He said her daughter had had too much to drink – she had gone pubbing with her friends the night before – and assured the witness that he would take her home.
“I went down to wait for her. I waited for 20 minutes, and she still had not come back,” said the witness. “So I called her handphone and she answered. She was saying: ‘Mummy, mummy, can you please come and get me?’

“I said: ‘Sure. Where are you now? I will come and get you right now.’ She said she did not know where she was. She said that he wouldn’t let her go unless she had sex with him. Then the line was cut off,” she continued.

She tried calling her daughter, but the phone had been switched off. Worried, she woke her two other children up and told them that their sister was in trouble.
Through her daughter’s friends, she managed to get Ken’s mobile phone number, but he did not answer his phone. Her two children continued calling their sister but got no response.
The mother then made a police report and called her husband, who was then in Kuala Lumpur, to tell him what had happened.
She said she did not know how many times she called Ken before he finally answered to say that her daughter was on her way home. He claimed that she could not call back earlier as her mobile phone’s battery was flat.

“I asked him: ‘Are you sure she is coming home?’ I asked him to just let her go,” said the mother, before breaking down.
She said Ken assured her that her daughter was indeed on her way home, but refused to give her his address. It was then around 6am.
Just then, her daughter came home on a motorcycle that had a sidecar, driven by a 60-year-old sweeper who gave her a lift. He had found her at a side road beside Block 203, Toa Payoh North.

The woman said that her daughter’s hair was in a mess, and she appeared “very frightened” and was crying when she ran towards her and hugged her.
She took her to her room and asked if he had forced her. She nodded her head.
The maximum penalty for rape is a jail term of up to 20 years. The offender may also be fined or caned.

A MAN accused of rape claimed that the woman was the one who tried to seduce him while they were dancing at a popular nightspot.


Ong Mingwee, 28, who runs a family provision shop, stated that the 22-year-old woman had agreed to have sex with him, and no force was used.

He is alleged to have raped the woman at a flat in Toa Payoh North in the early hours of Feb 12, 2009.

In his statements, which were admitted in evidence on Wednesday, he said he did not understand why the woman had lodged a report against him.


Investigation officer Station Inspector Azman Mohd Hussin, read out the statements he recorded from Ong in court.

Ong stated that when he met the woman and her friend for the first time at Zouk, she was quite high.


He said they were together most of the time that evening. While drinking, he said she pulled him to the dance floor and the sexy way in which she danced, made it seem she was trying to seduce him.

After the club closed, they left in a taxi for home. They started kissing and when he asked if she wanted to go to his place, she agreed, he said.

But when they were at his flat, she started to cry, saying she was scared and wanted to go home.

THE blood-alcohol level found in a young woman at the time of an alleged rape by Ong Mingwee was more than three times the legal limit for drink driving.


The 255mg ethanol per 100 ml of blood was above the toxic level but below the lethal level of 350mg, said a forensic pathologist.

Senior consultant forensic pathologist Wee Keng Poh testified on Friday at Ong Mingwee's rape trial that the level found on the then-22-year-old woman would physically or mentally incapacitate her.

She would also not be capable of giving consent. Dr Wee said the alcohol she had taken would reduce her ability to protect herself, impair her judgment, her perception of others, as well as her ability to resist both physically and verbally.

Ong, 28, is said to have raped the woman at a flat above his family-run minimart at Toa Payoh North in the early hours on Feb 12, 2009.

After calling 14 prosecution witnesses, the prosecution closed its case.

District Judge Hamidah Ibrahim called on his defence. Ong, who elected to give evidence, will take the stand when hearing continues on Feb 14.

The maximum penalty for rape is 20 years' jail and fine or caning.

Alleged rape victim 'too drunk to defend herself'

A YOUNG woman who was allegedly raped by a man she met at Zouk two years ago, was so drunk that she was incapable of giving her consent or fighting back against her assailant.

Senior consultant forensic pathologist Wee Keng Poh gave his opinion when he testified on Day 5 of Ong Mingwee's trial.

Dr Wee said the woman's blood alcohol level at the time of the alleged rape could be 255mg ethanol per 100ml of blood - above the toxic level but below the 350mg/100ml lethal level.

Dr Wee, the last witness for the prosecution, said in the case of the alleged victim, the alcohol she had taken would have reduced her ability to protect herself and impaired her judgment, perception of others and ability to resist both physically and verbally.

District Judge Hamidah Ibrahim called upon Ong, 28, to enter his defence. After conferring briefly with his lawyer Goh Siok Leng, he said he would give evidence in the witness stand. He will do so when the hearing continues on Feb 14.

Ong, who runs a provision shop in Toa Payoh North, is alleged to have raped the then 22-year-old woman at a unit above the shop in the early hours of Feb 12, 2009.

A MAN accused of raping a young woman he met at a club told a district court on Monday that he had sex with her with her consent.

Ong Mingwee, 28, who helps run a family minimart business in Toa Payoh North, denied raping the 22-year-old woman in the flat in the early hours of Feb 12, 2009. He said he neither forced her to have sex with him nor did he tell her that she could not go home unless she had sex with him.

Ong had met the woman for the first time at Zouk earlier when he went clubbing with his elder brother. He was introduced to the woman, who danced with him that night. When the club closed, he offered to take her home. He claimed that while they were in the taxi, they started kissing and she agreed to go his place.

In the flat, he took her to his room while he went to ease himself and have a smoke. When he returned, he heard her cry, saying she was scared and wanted to go home. Shocked, he tried to calm her down and assured her that he would not harm or hurt her in any way.

The court heard earlier that the woman called her mother and her girlfriend, who had been with her earlier at Zouk, telling them she was scared and wanted to go home. But she had no idea where she was. If convicted Ong faces a jail term of up to 20 years and a fine or to caning.

ONG Mingwee was sentenced to seven years' jail and eight strokes of the cane on Tuesday for raping a 22-year-old girl he met hours earlier at a nightspot. But the 29-year-old self-employed man who runs a family-owned provision shop at Block 203 Toa Payoh North is appealing.

He was found guilty, after a nine-day trial, of raping the woman at a unit above the shop in the early hours of Feb 12, 2009.

Ong was introduced to the woman at Zouk disco at Jiak Kim Street when he went there with his brother. He claimed that the woman seduced him when they were dancing at the dance floor.

He further testified in his defence that while taking her home in a cab at about 4am, they kissed, and she agreed to his suggestion to head for his place.

But the prosecution's case was that the victim, while still in her semi-conscious drunken stupor state, made frantic phone calls to her mother and friend to take her home when she found herself in a place she did not know.

She had cried and said repeatedly that she wanted to go home but Ong would not let her leave unless she had sex with him.

The main issue was whether sex was consensual.

District Judge Hamidah Ibrahim rejected his defence that sex was consensual. She found that the prosecution had made out a case beyond reasonable doubt.
